eBeauty Terms of Service

Introduction

Welcome to eBeauty, a premier beauty services platform operated by eBeauty, a company duly incorporated and registered in Dubai, United Arab Emirates. These Terms of Service ("Terms") govern your use of the eBeauty platform, services, and website (collectively referred to herein as the "Platform").

By using any part of the Platform, you enter into a binding contract with eBeauty and agree to these Terms. Please ensure that you read them carefully and retain a copy for your records.

We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Platform after any changes indicates your acceptance of the new Terms. If you disagree with the modified Terms, you should discontinue your use of the Platform.

Our Privacy Policy also applies to your use of the Platform and forms part of these Terms. It outlines how we handle your personal data.

Key Definitions

For clarity, the following capitalized terms are defined as such within these Terms:

"Appointment" refers to a scheduled booking for services provided by a Partner through the eBeauty Platform.

"Cancellation Policy" outlines potential fees charged by Partners for canceled Appointments, which may be up to the full value of the Appointment.

"Client" or "you" refers to you, the user of the eBeauty Services, or the purchaser of Partner Services.

"Confirmation" is the written acknowledgment we send you regarding your Appointment or Order.

"eBeauty Account" is your personal account on our Platform, containing your details and history of interactions.

"eBeauty Services" encompass all services provided by eBeauty to you through the Platform, including booking, payment, and account management functionalities.

"Partner Contract"is the agreement between you and the Partner regarding the provision of their services or products.

"Partner Credit"represents prepaid credits purchased through the eBeauty Services for availing Partner Services.

"Partner Profile"is the dedicated page on the Platform for a Partner, displaying information about their services and products.

"Partner Services"are the services and goods offered by a Partner for sale on the eBeauty Platform.

"Partner Terms of Sale"includes specific details and conditions related to the sale, such as date, time, price, and location, provided at the time of booking.

"Partner Voucher"is a voucher available through the Platform, redeemable for services or products from the Partner.

"Partner"is a third-party provider whose services and products are available on the eBeauty Platform.

"Pay In-Store Service"refers to services booked via the Platform but paid for at the Partner's location.

"Payment Processor"is the third-party service facilitating payments on the eBeauty Platform.

"Promo Codes"are codes issued for promotional discounts on Partner Services, subject to specific terms.

eBeauty Services

eBeauty connects you with a curated selection of Partners offering a spectrum of beauty and wellness services, such as hair styling, and beauty treatments. The eBeauty Platform facilitates the scheduling of appointments for Partner Services, placing orders for products, and enables direct payment for these services and orders. Please note that eBeauty itself does not provide any of the Partner Services or fulfill orders; we serve solely as a bridge between you and our Partners.

When you utilize the eBeauty Services, you are entering into a contract with eBeauty governed by these Terms of Service. However, it is important to understand that the contract for the actual provision of Partner Services is exclusively between you and the respective Partner.

eBeauty functions purely as an intermediary, including acting in the capacity of an agent for each Partner to organize and finalize your bookings and purchases.

Your payments made on the eBeauty Platform settle your obligations to the Partner for the respective service or product ordered. This arrangement excludes any services or products where payment is made directly at the Partner's establishment, which is referred to as Pay In-Store Service.

Services Provided by Our Partners

Anytime you book a Partner Services via the eBeauty Platform, you also enter into a contract with the relevant Partner, which is subject to their specific terms of sale.

The Partner is solely responsible for providing the services according to their own terms. While eBeauty is not a party to that contract, we facilitate the connection between you and the Partner through our platform.

Our Partners' Commitments

Our Partners are obligated to deliver their services in accordance with the terms they set forth. Although eBeauty requires Partners to ensure their offerings on the platform are accurate and not misleading, we cannot independently verify all information provided by them. It is the responsibility of each Partner to guarantee the availability and accurate description of their services. Note that the images and descriptions on the eBeauty Platform are for illustrative purposes and the actual services may differ.

Your Consumer Rights

As a consumer, you have legal rights for services that are not rendered with reasonable care and skill or do not match their description. You can obtain advice about these rights from consumer advisory services in your area. Rest assured, nothing in these Terms of Service infringes upon those statutory rights.

Engaging with the eBeauty Platform

To make a booking or place an order through the eBeauty Platform, you may check out as a guest or create a eBeauty Account by signing up and providing certain information, including your name, contact number, payment details, and chosen password.

Accuracy of Information

You must ensure that all information you provide to eBeauty is accurate and kept up-to-date. eBeauty reserves the right to verify your information and may deny access to the eBeauty Services or Platform without providing reasons.

Using eBeauty Responsibly

To optimize your experience with eBeauty, you should:

  • Contact Partners directly – Each Partner Profile on the platform includes contact details, facilitating direct communication.(email id)
  • Understand the Partner Contract – Our Partners may include specific terms regarding, cancellations, or refunds. Always read these terms carefully before proceeding.
  • Ensure secure checkout – eBeauty’s payment services are designed to protect your online transactions. Verify that the checkout link is secure, indicated by 'https://' at the beginning of the URL.
  • Conduct independent research – Check reviews on trusted platforms alongside those on eBeauty to gauge the quality of a Partner's services or products.

Health and Other Relevant Disclosures

It is solely your responsibility (or that of the person receiving the services) to inform the Partner in advance of any health-related conditions or specific needs that may impact the service. This includes verifying the suitability of any product prior to purchase and soliciting additional information from the Partner if necessary.

Should there be a failure to disclose such critical information, neither eBeauty nor the Partner will bear liability for any resulting harm or losses that could have been avoided with prior disclosure.

eBeauty Service Communications

In the course of providing you with eBeauty Services, we may need to send you service-related electronic messages. These communications may serve various purposes, such as confirming your device's connection to your registered phone number for security reasons, or providing updates on the status of your appointments, such as changes by the Partner notifications.

By engaging with eBeauty Services, you consent to receive such automated messages at the phone number you've provided. These messages may contain promotional material alongside pertinent information regarding your account or transactions. Please note, receiving promotional content is not a prerequisite for using our services. You have the option within your profile settings to opt out of non-essential communications.

Our Privacy Policy provides detailed information on how we handle your personal data and the types of messages you may receive.

Booking Appointments and Placing Orders

The eBeauty Platform enables you to browse and select the Partner Services you desire. Before finalizing your booking, you have the opportunity to review and amend any mistakes. You will be informed of any applicable Partner Terms of Sale, including, cancellation, or no-show policies. It is crucial to thoroughly review all details before confirming your transaction.

A contract with the Partner is established once we send you a Confirmation after you've made a booking or order. All services listed on the eBeauty Platform are subject to availability, and we reserve the right to accept or decline bookings or orders on the Partner's behalf. You will receive a Confirmation receipt from eBeauty via email, Whatsapp or SMS to the contact details associated with your eBeauty Account. Should you need a tax receipt, please reach out directly to the Partner.

Remember to arrive at the Partner's specified business location to avail the services as per your booking, detailed in the Partner Terms.

Vouchers Issued by Our Partners

Our Partners may offer vouchers for use on services, or allow you to purchase vouchers for future services. These Partner Vouchers are subject to the Partner's discretion.

When you buy a Partner Voucher, it adheres to the terms of sale presented at the time of purchase. The Partner manages the issuance and redemption of vouchers in accordance with their own contract terms. eBeauty does not partake in the Partner Contract and holds no responsibility for the Partner Vouchers. Offers may be withdrawn at any time, unless you've already secured an appointment or order based on the offer and received a Confirmation from us.

Promotional Codes Provided by Our Partners

Our Partners might issue promotional codes applicable to their services. These codes are at the discretion of the Partner and may be retracted at any moment, especially in cases of misuse or technical complications.

If a promotional code is personalized for you, it is not to be shared with others. Conversely, if a code is made public, feel free to share it. Should there be reasonable grounds to believe that a code has been misused, we, along with the Partner, reserve the right to invalidate it

The Partner establishes the terms for any promotional codes and is responsible for fulfilling the services related to them. eBeauty is not liable for the issuance or management of these promotional codes by our Partners.

Payment for Partner Services on eBeauty

Prices Set by Our Partners

The prices for any services or products, along with any applicable delivery or processing fees, will be as stated on the eBeauty Platform at the time of your booking or order.

Should you choose to purchase additional goods or services at the time of your appointment, the total cost may be adjusted to reflect these additions.

eBeauty Partners may offer promotional discounts, which will be applied to your final payment amount.

Gratuities for Services

Should you decide to tip your Partner for a service rendered, eBeauty will facilitate this through a post-service notification on our Platform. Tips are purely discretionary, above the service charge, and fully intended for the Partner. eBeauty, as a limited payment collection agent, will process the tip transaction, and the Partner will receive the full amount of any gratuity you provide, net of any payment processing fees.

Payment Process for Partner Services

By engaging with eBeauty, you commit to providing a valid payment method and agree to pay for all services rendered by our Partners. Payments can be made through eBeauty’s Payment Services or directly to the Partner for in-store services.

If you opt for eBeauty’s Payment Services, we will process your payment on behalf of the Partner, covering the total service cost, including taxes and any additional charges. All transactions will be conducted in the currency specified in your booking confirmation. You are responsible for any currency conversion costs or other related charges.

For transactions designated as Pay In-Store Services, you will settle the payment directly with the Partner using traditional payment methods. Some Partners may also offer the convenience of charging the payment method linked to your eBeauty Account at the time of service.

Payment Processing

eBeauty collaborates with a third-party payment processor to facilitate card payments linked to your eBeauty Platform account. The handling of payments will adhere to the terms and privacy policies of the Payment Processor and your card issuer, in addition to these Terms of Service.

While eBeauty endeavors to provide reliable Payment Services at all times, we cannot guarantee uninterrupted access or that the service will be error-free. We are not liable for errors made by the Payment Processor and will notify you of any planned service interruptions whenever possible.

Tax Responsibilities

Our Partners are responsible for accounting for any indirect taxes (such as sales tax, VAT, GST, or service tax) associated with the services provided. eBeauty’s role is limited to facilitating payments; we do not levy taxes on the Partner's services.

VAT or any applicable sales taxes included in the listed prices on eBeauty will be charged at checkout. For orders placed directly with a Partner, it is the Partner's responsibility to provide a tax invoice upon your request.

We ensure that taxes are applied to all products in an order, and for shipping costs, the highest product tax rate within the order will be used.

Appointment Adjustments and Cancellations on eBeauty

Rescheduling an Appointment

Should you need to change the date or time of your appointment after receiving a confirmation, you can do so via the eBeauty Platform two hours before. The ability to reschedule is contingent on the Partner's policies and availability. We recommend familiarizing yourself with the Partner's Terms, including the cancellation policy, before booking.

Deposits and Partner Policies

Partners on eBeauty may require a deposit to confirm your booking or order, which may be non-refundable. We urge you to review the Partner's Terms before confirming your transaction to understand any deposit requirements. eBeauty is not accountable for any deposits made directly to Partners.

Cancellations and No-Shows

Cancellations can be made through the eBeauty Platform, provided that the appointment does not fall within the Partner's specified cutoff period, typically 4 hours hours before the appointment. If a Partner has a cancellation or no-show policy, and you fail to meet these terms, eBeauty may process a charge on your card on behalf of the Partner, potentially up to the full cost of the appointment. Please review these terms when booking to avoid unexpected charges.

Upon canceling the online payment will be refunded to eBeauty account as credits that are applicable to book another appointment, On No-show no refunds will be given.

Access Restrictions

eBeauty reserves the right to restrict your access to our services or platform in circumstances including, but not limited to:

  • Repeated cancellations, no-shows, or other actions that negatively impact our Partners’ experiences.
  • Failure to pass credit or fraud prevention checks associated with payment processing.
  • Suspected fraudulent or illicit activities linked to your account.
  • Suspected compromise of account security.
  • Inappropriate, abusive, or offensive behavior toward eBeauty staff or Partner employees, whether online, via communication within our platform, or in person.
  • Violations of our Terms of Use or any other conditions stipulated in these Terms of Service.
  • Any actions deemed by eBeauty, at our discretion, to be detrimental to the quality of services provided.

Additionally, our Partners have the autonomy to impose restrictions on their services offered through eBeauty, which may include limiting access to their profiles, services, or the ability to book appointments.

Liability

eBeauty's liability for negligence, breach of contract, or other transgressions will be limited to foreseeable loss and damage. Foreseeable means that the loss or damage could be anticipated by both you and us at the time of agreement to these Terms of Service.

We do not assume liability for indirect losses such as lost profits, lost business, or administrative disruption.

However, we disclaim liability for death or personal injury caused by the salon negligence, also for fraud or fraudulent misrepresentation, or any other liabilities that cannot be excluded or limited under UAE law.

We are not responsible for the quality of Partner Services; such responsibilities rest solely with the Partners per your agreement with them.

Indemnity

You agree to indemnify and hold harmless eBeauty and its subsidiaries, agents, managers, and other related personnel from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of:

  • Your use or misuse of our services or platform.
  • Information or content you provide, including any false or inaccurate information.
  • Any violation of these Terms of Service or applicable laws, regulations, or rights of third parties.
  • Your misconduct, whether negligent or intentional.
  • Use of your eBeauty account by others with or without your consent.

Termination of Terms of Service

Upon termination of these Terms, eBeauty will delete your personal data within thirty (30) days, unless we are required to retain such information to comply with legal obligations.

General

Platform Fees

The use of the eBeauty Platform is currently free for clients. eBeauty reserves the right to introduce a fee for the use of its platform. Should we decide to implement such fees, we will notify you beforehand and you will have the choice to either continue or cease using our services.

Assignment

Your rights under these Terms of Service are personal to you and may not be transferred or assigned without eBeauty's prior written consent.

Notices

eBeauty may provide notices through general announcements on the Platform email. We will receive notices at support@ebeauty.ae or at our registered address in Dubai, UAE.

Entire Agreement

These Terms of Service, along with any documents referenced herein, constitute the entire agreement between you and eBeauty, governing your use of our services and superseding any prior agreements. The provision of Partner Services and Products is governed by separate contracts with our Partners.

Enforcement & Severability

Any failure by eBeauty to enforce a right or provision under these Terms does not waive that right or provision. If any term is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

Governing Law

These Terms of Service are governed by the laws of Dubai, UAE. Both you and eBeauty agree to submit to the non-exclusive jurisdiction of the Dubai courts for any disputes.

Interpretation

The definitions of terms herein shall apply equally to both the singular and plural forms of the terms defined. Whenever the context may require, any pronoun includes the corresponding masculine, feminine and neuter forms.

Updating the Service and Terms of Service

These Terms of Service were last updated on 15, November, 2023.

eBeauty reserves the right to update these terms at any time. We will notify you of any changes via the Platform, your account, or through email. Your continued use of the Platform after changes have been posted indicates acceptance of the updated terms.

  • Address the matter directly with the Partner for a resolution.
  • Leave a review on the eBeauty Platform reflecting your experience.

In cases where a resolution is not reached with the Partner, and if deemed fair by eBeauty, we may at our discretion offer a refund as a last resort. Such refunds will be processed through our payment services.

While we take all feedback seriously, please note that eBeauty is not responsible for the provision of Partner Services and is not obligated to offer refunds or compensation for dissatisfaction with such services.
